Crime of theft and offenses of misappropriation are key objects of study in the penology. Both of them are the special structure of crime constitution. It is also difficult to distinguish them, and there always exist a dispute about this. Scholars in our country made a in-depth study on crime of theft and offenses of misappropriation and got a lot of achievement. From that, we can see:these are few monographs and it doesn’t form theory systems.In this essay, a specific case of "Li mou’s Theft" is carried out to elaborate something about crime of theft and offenses of misappropriation. First we will analysis the process of the case and the sentence, and then we focus the most controversial part, namely, what the standard of crime of theft and offenses of misappropriation. We refer to the provision of the current criminal law to study this problem, and advance reasonable proposals.This paper can be divided into three parts:The first part is a basic introduction of the case, and explains the case to the controversy over the course of focus and results, in order to make further research on the following.The second part main makes a study of the case. It analyses criminal objects and criminal behavior. By means of these theories, we can explain the result of the case.The third part is some legal thinking from the case. According to the main question of the case, putting forward suggests to perfect our theory of t crime of theft and offenses of misappropriation, in order to benefit the judicial practice.
