The Case Analysis On The Owner’s Personal Information Disclosure

The technology has changed the survival status of the human, information is the means of human communication. Information can not only hely identify the ivdividual’s identity, but be also more capable of human use to create greater value. Advances in technology promote access to information, access to information promotes the improvement of the technology. With the development of our property,real estate, the increasing of rural communities, the convenience of network, and an increasing number of the executive authorities and non-executive authorities to grasp the personal information. The disclosure of our owner’s personal information is getting worse. This is not only related to the normal flow of information, but also related to the realization of the individual’rights. In order to prevent the leakage of personal information, we need regulate more from the legal aspects, in particular, to strengthen the prior supervision and prevention of the leakage of personal information.Discussed on the owner’s personal information disclosure of ShenZhen Futian District combined with foreign experience and legal provisions on the protection of personal information, as well as the current status quo of our owner’s personal information protection, I conducted the research on the protection of the owner’s personal information. I consider that the protection awareness of our owner’s personal information is weak, and information disclosure problem is serious. We should set up a specialized administrative agencies to protect personal information and appoint someone to be responsibe for overseeing. Institutions of mastering the large number of owner’s of personal information should be registered, reviewed and managed and meanwhile we should increase penalties to the agencies that leak the owner’s personal information. This article is divided into three chapters. The first chapter is the case profiles and case analysis. This article describes two cases.Case one is the owner’s personal information disclosure of160community in ShenZhen. Case II two is the information leak of8000owners in ShenZhen. The two cases occurred in the same region, the time of occurrence is similar, they are both typical. The second chapter discussed several issues in the cases. The article considered that we should protect the owner’s sensitive and secretive personal information and analyzed the legality of information gatherers. Finally,we discussed the law what should be applicable of the owner’s personal information protection.The third chapter is the reflections on improving the protection of the owner’s personal information of China and emphasis on administrative supervision. We formulate a unified law to protect the personal information. It also introduced the measures to prevent the owner’s personal information disclosure from different perspectives and the requirements of standardizing the collection procedures. The chapter also describes the experience of other countries and we hope to learn something from it and gain experience.
