At present, the embezzlement of public funds is the job crime incidence in the field of higher crime, criminal laws and regulations to prevent the occurrence of such crimes is an important issue facing the legislation. Exist in the legislation, the provisions of the embezzlement of public funds for "personal use "and" personal gain ","what name recognition "has always been theoretical and practical problems, and correct analysis of existing laws, application of the law to make a proper explanation for our country to deal with embezzlement crime can not be underestimated.This article is by Wang Chenghu embezzlement case as an example of how our current legal provisions on embezzlement of public funds, analysis of the behavior for personal use qualitative discussion of the existing legal provisions of the embezzlement of public funds. This article is divided into three chapters, the first on the case and the verdict. Theory of subjective and objective aspects of the behavior identified in the second chapter is a combination of China’s criminal, and based on the crime constitutes a theoretical analysis of current laws and regulations of China on the embezzlement of public funds to explore "personal gain","return personal use "and" different views of what the name of " controversial issues, and made a personal point of view. In the last chapter, the author of the Western theory of criminal law thinking on the value of China’s criminal legislation that currently used misdemeanors’ Legislative Orientation has a lot of limitations, is the long-term strategy to build a comprehensive management mechanism, through these revelations I perfection of relevant laws put forward some opinions and suggestions.
