| With the acceleration of the process of Chinese market economy, labor dispatch industry in China has also got rapid development and played an important role in promoting economic development. On January1st,2008implementation of the Labor Contract Act and its regulations to provide the dispatch system in China for the first time, providing a legal basis for the protection of the legitimate rights and interests of laborers, and regulated labor dispatch industry in China to some extent. But in actual operation, along with the deepening of complicate labor relations, against the legitimate rights and interests of laborers emerging, flaw exposed out of the legal norms. Now, how to ensure the legitimate rights and interests of laborers in labor dispatch to ensure healthy and stable running of labor dispatch industry in China is already a problem not to be ignored in the process of building a harmonious society.So, first of all, this paper begin with the development of labor dispatch in global, in combination with the development process and status in China in order to get the real life state of laborers and summarize the current problems of labor dispatch by making an investigation among them. Meanwhile make a deep analysis on the former material. Secondly, analyze the abroad advanced legislation experience to find out the lack of our current system in the protection of rights and interest of laborers, make clear the enlightenments that we can get from the abroad advanced legislation experience. At last, reference abroad advanced of legislative experience and other scholars of research results, combination in China labor dispatch industry now development of reality, give personal suggestions to the protection of laborers’rights and interests in labor dispatch process.Hope that can improve the ability of operation of current labor dispatch industry,make laborer’s legitimate rights and interests get effective protection and establish harmonious labor relationship in the whole society. |
