The Research On Legal System Of Government Procurement

As an important means of today’s governments mastering the social and economic life, government procurement is playing an increasingly important role in domestic and international trades. Government procurement includes not only the procurement of the government’s own consumption, but also includes the procurement of public works facilities for social and public services. Through the government procurement, we can not only promote effective competition in the society but also can avoid the phenomenon of corruption in the process. What’s more, government procurement can also promote the government’s macro-control, promote the adjustment of industrial structure, promote the development of poverty-stricken areas, promote the employment of its residents, and promote the realization of environmental protection policies. Government procurement has been200years time. Especially some Western developed capitalist countries in the world establish the relative maturity of the government procurement system after the economic crisis of the1930s However, China’s government procurement system developed lately. The first government procurement in China is contract through public bidding by Zhi-dong Zhang in1902. Because the time of Government procurement in China is short, therefore, China’s government procurement laws and regulations are not perfect. With economic development and the expanded scale of government procurement, the law system of government procurement is also on the development and improvement. Especially Government Procurement Law of the People’s Republic of China was officially promulgated and implemented in the first day of January2003.This indicates that China’s government procurement official is on the legal and standardized way. However, the practice of Government procurement still exists many questions. This article will put forward specific suggestions for improvement through the analysis of the problems.Firstly, we will talk about the general theory of government procurement such as concept、 characteristics、 origin、 development、 basic principles、 functions and theoretical basis. Secondly, we discuss and research the government procurement system in the United States, South Korea and the EU at the same time we summarize the useful experience of the foreign government procurement systems. Again, this article discusses the problems in China’s government procurement system. For example, Government procurement laws and regulations system are not perfect. The level of the overall quality of the procurement staff is not high. The interests of suppliers were often damaged. It also has many questions in appeal provisions. And the level of the market is not high. Last, this paper put forward many measures of the improvement of China’s Government procurement. For example, we must improve the legal system of China’s Government procurement. We improve the mix of skills of procurement staff. We improve the Appeal System. And we must improve our regulatory approach. At the same time, we talk about some questions such as e-procurement and green procurement.
