Chongqing built the first large-scale construction of public rental housing, expanding the coverage of housing security in 2010 which is a major leap forward of China’s housing security system. In this context, the construction of affordable housing in Chongqing Municipality, for example housing to protect the legal system in China, has important theoretical significance and practical value. From theory through the analysis of status of housing security system in Chongqing and the problems put forward recommendations to improve the legal system of China’s housing security, trying to break out the deficiencies and limitations of the original research, trying to the legal system in the housing security of theoretical research and The actual construction has been further expanded and deepened. From practice, on the one hand, to improve China’s housing security system, and promote the healthy development of the construction of affordable housing; on the other hand, the proposed measures to improve the legal system of China’s housing security for our country after the construction of affordable housing to provide a good legal basis.After years of exploration and practice, most parts of China have established a housing security system and have achieved a certain social effects. But it also faces many issues, such as the low level of affordable housing legislation; to protect a single way, only the in-kind subsidies and monetary subsidies in two forms; with the rental process, with rental program injustice, exit mechanisms are inadequate, as well as the convergence of the system flaw, and so on.From the perspective of jurisprudence how to improve China’s housing security system is still need to be solved. In order to give full play to the role of the housing security system, so that the institutionalization of affordable housing, legal, housing system must improve the legislative level, multi-level housing and legal system in China; the establishment of specialized housing security agencies; national network of housing data management platform and the housing register management system combining access to censorship; Continuously improveing the program with rent、expanding our housing by way of subsidies、improveing the housing exit system, and so on to achieve a virtuous circle of China’s housing security system as well as affordable housing in Chongqing Municipality. Three thousand words of this article, in addition to the introduction and conclusion, are divided into four parts:The first part is the introduction to China’s housing security system. In this part, starting from the concept and connotation of China’s housing security system, the paper analyzes the main form of housing security system and regulations have been gradually perfected its legal basis.The second part is about status of Chongqing City housing security system, and problems.It points out the problems of the housing security system in Chongqing Municipality. Specific performance review of the access system is imperfect, and with rent the program to exit the system is not perfect two aspects.The third part is the foreign housing to protect the legal system and enlightenment. The main study of the United States, Japan, Singapore housing, protect the legal system and the Enlightenment are summarized, the revelation of the national housing security system, including improve the housing security system, legislation, clear housing management agencies, strict access mechanism, the appropriate rents charged at the standard, flexible housing subsidy system and exit system and housing construction fit between the seven areas.The fourth part, is to improve the legal system of China’s housing security.
