The birth is s basis which the humanity can continue. With human society’s unceasingprogress and people’s unceasing increase, the birth behavior is no longer just aphysiological phenomenon and natural events, is a kind of social behavior and socialphenomenon. From a legal point of view, the birth behavior deserves as the most naturalrights of the citizens of a strong protection of the constitution and laws. The current legalprovisions on reproductive rights is very brief and did not involve single women havereproductive rights. However, single women have become a social phenomenon in modern.Single women’s needs of productive freedom are growing. Whether single women havereproductive rights is one of the urgent problems of jurisprudence. Abroad for singlewomen’s reproductive rights of appeal as early as during the feminist movement has begun,but we began to study this problem in recent years in China. Most hold the opposing pointof view, but the concept of the author is just the opposite, that single women should haveaccess reproductive rights. I conduct a detailed analysis of single women’s reproductiverights from the single women’s appearance and present situation, also from contents ofreproductive right. Single women need complete reproductive rights from their appearanceand present situation. From the legal nature of the reproductive rights, the reproductiverights belong to basic human rights and personality rights, so single women should hasreproductive rights. And also many reasons against the reproductive rights of singlewomen do not hold in the legal principle. Single women should have reproductive rights intheory, I think we can set some certain restrictions to ensure that the sight to reasonablyexercise, because of the special demographic situation in China. So, single women’sreproductive rights should be a reasonable exercise under the control of the legal, andshould not be denied.
