Research On Government Information Publicity In Environmental Treatment Under Rule Of Law

Environmental information publicity is one of the main requirements in rule of law in environmental treatment. With environmental information publicity by government, people’s right to know about environment can be protected, the environmental administrative decision can be improved and the cause of environment protection can be promoted. The theoretic basis of environmental information publicity is environmental justice, which means the balance between government and people, the strong party and the weak party. The regulation of governmental information publicity and the environmental information publicity rules indicates that the legal system of environmental information publicity has been established. However, there are still some issues which should be fatherly solved.This dissertation researches information publicity in environment treatment with the logic of firstly put forward the questions, then analyzes them and then solves them. Specifically speaking, the dissertation introduces some fundamental definition such as government information, environment information and other related notions. The necessity and the theoretic basis of environmental information publicity is also analyzed; then this dissertation points out the deficiencies of the current legal system in China’s environmental information publicity. Some typical cases was used to demonstrate the flaws in current legal system; at last, this dissertation put forwards the specific measures to improve the legal system of environmental information publicity.This dissertation researches environmental information publicity and brings some points as below:firstly, this dissertation maintains that environmental information publicity is necessary for right to know about environment and environmental participating right. The theoretic basis of environmental information publicity is environmental justice; secondly, there are some flaws in legislation and law enforcement, the judicial protection is also very weak; thirdly, environmental information publicity in other countries is worthy to learn. This dissertation introduces the experience of the United States, the European Union, Japan and so on and maintains that some legislation can be adopted; fourthly, this dissertation maintains that the act of deny to environmental information publicity should be defined as administrative omission to strengthen responsibility.
