Inducitve invetstigation refers to the investigation mode in which law enforcement officers take certain inductive strategies so as to induce a subject to commit certain crimes, thus arrest the subject. It has become a common practice in many countries when investigating crimes. It is popular especially for those crimes which have the features of coverteness and good organization. Considering that this mode of investigation has the potential risk of infringing the subject’s lawful rights, some countries regualte this practice through the written or case law.In our country, the problems in the inductive investigation practice are mainly as follows:lack of correct theories, lack of sound regulations, and lack of guidance. This is not only harmful for the protection of lawful rights, but also harmful for the control of crimes. Above all, we should pay special attention to the inductive investigation mode when building a socialist country ruled by law.when investigating drug dealings with inductive investigation have the features of covertness and good organization there are many problems such as infringing the subjects’ lawful rights. So, this thesis is threaded by a dealing drug cases and focus on its study on legitimacy, legal responsibility and proposals.This paper is divided into three parts including the introduction, body and conclusion.The induction has introduced the case..The body is divided into three chapters.Chapter one contains the basic theories of encouragement investigation. Beginning with one case, this chapter draws the concept of inductive investigation. Then focus the characteristics. Finally, linking up with the case.Chapter two mainly introduce the legitimancy of induce the chapter consists of three sections. They are rationality, legitimacy of inductive investigation mode and finally linking up the case.The third chapter mainly induce the result for the whole case. In this part, the writer tries to analyze different remedial measures for the unlawful inductive investigation.
