Analysis Of Cases About Legal Protection For Gene Privacy

As a basic personal right,privacy has always drawn a widely concern.However,protection for privacy right in our country is far from meeting people’s needs,there are rarely relevant legislations and the existing legislation related to privacy can not meet keep pace with the development of our society.The first case of anti-genetic discrimination occurred in Foshan in Guangdong,which discloses the deficiency of protection for gene privacy right and it also indicates the existence of genetic discrimination in our country. So we must go against the advocacy of gene determinism and should make gene privacy legal,and only in this way,can we protect it efficiently.Specifically,this thesis can be divided into three parts:The frist part is concerned with the brief introduction of one typical case and some focus matters about it.This paper will introduce the process of the first case about anti-genetic discrimination in Guangdong,then it will analyze the focus matters of this case.After that,the question of legal protection for gene privacy will be raised.In the second part, we will analyze the protection for gene privacy right.We will talk about the content of it by starting with its definition and value. At the end of this part,we will put forward the problems problems being existed in the field of employment insurance and medical care.Some suggestions on how to protect the gene privacy right in our country will be put forward in the third part.This paper will state our current legislation about gene privacy right and principles that should be followed when it comes to genetic legislation.According to the statement,this paper comes up with some legislative proposals about protection for gene privacy right.
