The rights to subsistence is a basic right for humans, except for “the right tolife”. Anyone who wants to live, he or she should have living necessities, such as,food, water and basic living conditions, which should be upheld by soundenvironment. Without sustainable and habitable environment, any methods tokeep us survival will be useless.At present, people’s survival rights are badly influenced by climate change.“United Nations Framework Convention on Climate Change,1992” and “KyotoProtocol,1997” are legal basis for international communities to cope with climatechange with a multi-mechanism of “United Nations Conference on ClimateChange”.However, as “obligation to reduce emissions” accrued by “Kyoto Protocol,1997” expired by2012, international communities will lack legal basis for copingwith climate change in “Late-Kyoto” times, when people’s survival rights would bemore challenged. In accordance with international human rights law, the right tosubsistence is set by kinds of standards and protections’ mechanisms. Internationalhuman rights standards should be united with climate change mechanisms, onlyif,we can protect our rights to subsistence in the process of facing and coping withclimate change.
