A Research On The Clean-up Of Chinese Law：from2008to2010

Only adjust and regulate the laws now and then can governance andfunctions be realized. Laws, as the way of adjust social relations, should bekept the pace with the social and economic development so as to reflect thevitality and scientificity. Laws should also be coordinated inside theself-system to maintain the restraint and authority. Because the clean-up oflaws can bring about these functions, this kind of effort has never beenpaused in various level of laws and regulations. It is of great significance inthe establishment of the socialist law system with Chinese characteristics.However, problems and flaws are still existed for the institutional defect andpractical myth.The object of this study is the procedure and result of laws from2008to2010. On the base of the data of law clean-up (from2008to2010) and with the integration of quantitative and qualitative research, we teased andsummarized the goals and values. As a result, we find out that the clean-up oflaws won’t be disappeared and reduced in the form of the socialist lawsystem with Chinese characteristics. On the contrary, it will be more crucialbecause of the negative intrinsic attributes of statutes and some externalfactors, such as the present legislative system and the priority shifted ofimproving the socialist law system with Chinese characteristics.This paper has three sections. The first section is to analyse the lawclean-up about the beginning and development, institutions and procedures,objects and methods, techniques and forms. The second section is to studythe proportion, reasons, involved departments, the life cycle of laws and theflaws of the law clean-up (from2008to2010). In the last section, we thinkthe clean-up of laws is necessary, but it is difficult to eliminate thedepartmental interest. Therefore, the revolution of idea and the establishmentof the normalized mechanism should be taken seriously.
