This thesis begins with the cultural analysis of death penalty. Its startsfrom the laws and regulations on death penalty in the east and west, customsand habits and the perspective of people’s mentality, in order to carry out adetailed approach to the evolution of the concept of death penalty, and thecomplex influence this evolution brings to the building of a legal system. Thewriter thinks that death penalty is a measure of criminal punishment whichobjective is the deprivation of the right to live. As the people have a differentunderstanding of the cultural meaning of death penalty, therefore, the methodof executing death penalty and the deterrence effect it has on the society vary.We have already brought up the guiding principle of cautious application ofdeath penalty in legislation and judicial implementation. This is a majorimprovement in concept and it possesses a profound foundation of Chineseculture and coincides with the needs in the maintaining of order in the societyin the years to come. This is the basic direction of our nation’s legal reform inthe future.
