Research For China’s Patent Pledge Financing Of The Legal System

This is a new era of knowledge-based economy for capital，knowledge economywill become a dominant force in economic development. Patents as a typicalrepresentative of the intellectual capital, will receive more and more attention. In orderto play the role of knowledge and taking advantage of high technology, promotehigh-tech industrialization, we need funds. Now, there are much small andmedium-sized enterprises, especially the high-tech enterprises, have less of the fixedassets，but own quantity considerable patent technology. If the enterprises can make fulluse of their own advantages, use patent pledge to financing，this will be an extremelygood choice for those enterprises. In the past, research of the patent pledge was mainlyfocused on some of its basic theory, in this artical, I will give some attention to thepractical application of patent pledge on the basis of previous studies．The main contentof this article is divided into four parts：The first part is the financing overview of the patent pledge，include the concept ofpatent pledge finance, the characteristics、the need and the feasibility for paten pledge.Through the analysis of these issues, discusses the status and countermeasures ofChina’s patent pledge.The second part introduces the development of the patent pledge in United States，Japan and Taiwan, analysis and evaluates the development of the patent pledge in thesecountries，and point out similarities and differences among them．The third part introduces the implementation and the legislation of the patentpledge in Our country．The fourth part introduces the implementation and the legislation of the patentfinancing system pledge in our country．...
