For the creators, making movies is a kind of artisticcreation, a way of expressing thoughts for the directors and actors, movie should belong to thefreedom of expression. As a fundamental right, freedom of expression is the right protected byConstitution. Therefore, the right of freedom of expression of movie belongs to the rights protected byConstitution.China was and is implementing typical prior censorship or similar system to supervise movies. Inthis management mode, several movies cannot be shown on schedule for a variety of reasons. It willdirectly affect the exercise of fundamental rights prescribed by the Constitution that freedom ofexpression of film cannot be protected adequately.Through the analysis of reasons, the main reasonsfor that freedom of expression of film cannot be protected adequately by Chinese movies censorshiplie in the improper main body of censorship, the vague standard of review, the confused reviewprocess and so on. Only further improving current Chinese movie censorship can protect freedom ofexpression of movies more adequately. To construct a kind of movie censorship that can protectfreedom of expression of movies adequately, firstly movie censorship should be improved torationalize the main body of censorship, definitize standard of review, and legalize review process. Atthe same time, movie rating system can be adapted based on learning from the advanced experience ofother countries.
