Construction industry is the foundational industry in our country, which takes a keyeffect in the whole economic development. For protecting the construction contractor ‘srights and benefits, and under arrears the construction contractor ‘s price case isgrowing, The contract law devises the286thitem aiming at the problem in theconstruction projects cost were often behind in payment. The law gives priority claim ofthe contractor’s construction projects, to break the debt equal,and the cases of arrears ofProject solves. Due to the right of priority of construction projects is too simple, thisitem is not operational, the Supreme People’s Court had also given specific of the justiceinterpretation on the application of the Article286. The right of priority of constructionprojects is established for the project payment in arrears cases, different countries willface this problem, but the relevant provisions of the priority enjoyed by the variouscountries and regions for the Construction Contractor is not the same. If payment inarrears cannot be fundamentally solved the basic, living of the migrant workers will notbe able to be protected and eventually led to a series of social problems, this will affectthe social harmony and stability, which bring great harm to the country.From the perspective of legal theory, Exerting comparative study method accordingto the law of china and other countries, and put forward some of their own views onissues related to the right of priority of construction projects.
