By taking Bao gong drama in Yuan Dynasty and tragedy in ancient Greece as the research objects, this thesis tries to explore their ideological origin in " natural law" and" law of nature", the conflict and balance between state order and civil order by commoning and distinguishing among literature, philosophy and expression of emotion and morality in China and the West. By doing so, the paper further reveals the inevitable rules, humanitarian and human universals in human civilization evolution. This paper is divided into two parts. The paper first analyses interdependent relationship between God and man in Chinese and Western literature, drawing out some special relationship between their legal consciousness, social contradiction and primitive cognition. The paper then analyses two kinds of human social orders, the state order governed by legal rules and the civil order governed by habit rules, and their conflict and balance of the adjustment effectiveness of social life in law and ethics, law and emotion, national power and social power, justice and individual justice. Finally, the paper strips out the spirit of the law and its significance for reference hidden in the text through the above analysis, which may has some enlightenment on our construction of rational contemporary rules.
