The Research For Role Of The Third Sector In Maritime Accidents Investigation

As a Class A member of International Maritime Organization and one of the largest maritime countries, we should acquire the popular international aim. But we did not keep the same aim according to The Code Of The International Standards And Recommended Practices For A Safety Investigation Into A Marine Casualty or Marine Incident accepted by IMO, for example,"in the event of a traffic accident that involves a vessel or installation, the competent authorities shall ascertain the cause of the accident and fix the liability for it" regulated by Maritime Traffic Safety Law of the People’s Republic of China. It leads to the misunderstanding of investigation in marine accident, and pay attention to the responsibility and the punishment. The main purpose of the investigation has been ignored which is to make clear the objective and prevent the future accidents. And then there are some problems on investigation officers, practice and training, technique and the advices from the report. On the other hand, it has been suspected the justice of the investigation from the MSA, which related to safe system of human, vessel, environment and management. According to the research for the role of the third sector in the marine accidents investigation in some countries, just like America and UK, in view of the theory of service government and the government innovation of China, and in consideration of service manner of government, the theories of new public management and social governance, the paper researched about the public product and service provided by the third sector and the multi provider of public maritime safety service,and tried to reform the system of marine accidents safety investigation, in order to improve the third sector to play the more important role on the marine accidents investigation.It is consisted of the third sectors and the MSA, named marine accidents technique investigation board,but it is separated from the system of MSA. In conclusion the paper provided some thinking and advice on the new marine accidents safety investigation system.
