The Legal Problem Of Water-Saving System In Shanxi Province

As an important energy base of China, Shanxi Province is characterized by high water consumption, high energy consumption, and heavy pollution. Contradictions between the limitation of water resources and the fast-growing water demands getting increasingly sharp, resulting in scarcity of water in resources, facilities and good quality in Shanxi Province, is becoming the bottleneck of economic sustainable development in Shanxi Province. To overcome water shortage crisis in Shanxi Province, it is bound to complete the water-saving system, to strengthen the construction of water-saving management system, to improve the system of water-saving legal norms, and to carry out the implementation of water-saving policies and regulations. Currently the existing water-saving legal system in Shanxi Province is not perfect. The construction of water-saving system is not paid enough attention. Especially the legislative level is relatively low. There is serious protectionism in various departments. The legal system integration is poor. Conflicts on the duties and powers among departments often appear. The composition of water price is unreasonable. The government intervenes the water market too much. The important role of the market is pushed aside by the executive powers. The existing system could not effectively support Shanxi to build "Water-saving Type Shanxi".Water-saving system in Shanxi is in a relatively disordered condition. In the water affairs integration process, due to the new and old systems lack consistency, the old systems can not be completely compatible with the current water-saving management organization, which causes water-saving activities be alienated from the legal regulations. And as the responsibilities for the management specified in legal regulations are general requests, the management can not play a more effective role in water-saving affairs. Besides, as for the management of river watershed and area is not defined clearly, and the right assignment is unreasonable, and the organization setting is different from what is specified in the systems in the urban and rural water affairs integration, it has seriously obstructed the efficient and orderly operation of the related laws in water-saving. In the paper, the present situation of water-saving in Shanxi is analyzed. Based on the deep understanding of "Shanxi Province Water Resource Management Act", and compared to relative water-saving regulations and normative documents, the main problems in water-saving system of Shanxi Province are pointed out. In the comprehensive consideration of the incomplete system, scattered management authority, unclear duties and serious department protectionism, etc., some proposals to perfect the water-saving system and organization management mechanism are given. Modification suggestion to "Shanxi Province Water Resource Management Act" and related water-saving system is provided. The author tries to make efforts for "Water saving Type Shanxi", and to provide power for sustainable development of the economy and the improvement of the ecological environment of Shanxi.
