| As the society develops and the continuous high-speed development of economy, shortage of resources and environment deterioration has become the two key problems to restrict people’s survival and development. In order to solve these two problems,some developed countries take the lead in put forward the development of the Circular Economy,they want to use these new economic development model to replace the traditional economic model which have the large resource consumption and serious environmental pollution.Developed country as Germany,Japan,USA obtained the encouraging achievement in the development of Circular Economy,and they established mature circulation economic law system to ensure the smooth development of circular economy.Our country’s Circular Economy has just started,,and the legislation of Circular Economy is still in the process of being perfected.So,legislate for Circular Economic and establish a perfect legal system of Circular Economy is a very important and significant mission.The paper discusses the Circular Economy legislation for the Poyang Lake Ecological Economic Zone, to construct the legal system of the Circular Economy of the Poyang Lake Ecological Economic Zone.The paper is divided into five chapters:The first chapter is the foreword,the main content includes the background and significance of the paper,the literature review,the main research contents and the research method.The second chapter is the basic theory of Circular Economy and The Circular Economy Law,including the Circular Economy’s concept,characteristic,foundation,the concept of The Circular Economy Law,and the necessity of Circular Economy legislation.The third chapter analyses the necessity of Poyang Lake Ecological Economic Zone legislation.It is not only the important support of constructing the Circular Economic system but also the necessary condition of realizing the Jiangxi Province’ sustainable development.The fourth chapter analyzes the current situation of the Circular Economic Law at home and abroad,take Germany,Japan and USA for example,introducing their Circular Economy legislation and to provide a reference to establishing and perfecting our country’s Circular Economy Law.At home,there analyses the present situation of circulation economic legislation in Jiangxi Province.The fifth chapter is the core of the paper:the idea of how to construct the Poyang Lake Ecological Economic Zone’s legal system building.This part includes four points:the basic principles, system selection and constructing circular economic law system suggestion of the Poyang Lake Ecological Economic Zone.Construct the legal system of the Circular Economy of the Poyang Lake Ecological Economic Zone,the legislation is a fundamental.At first,it must implement and execute the existing laws strictly. And secondly,Jiangxi province should formulate the rules,and revises the existing rules.At last,formulating the laws and the rules which meet the Poyang Lake Ecological Economic Zone’s concrete demands. |
