The environmental liability insurance system can scatter about the risk, make the environmental indemnity duty of the business enterprise share with society, avoid the business enterprise bankruptcy for a huge sum of compensation, moreover, give the victim relief quickly and effectively.The environmental liability insurance system in western nations started earlier, so the insurance pattern is aging quickly, the insured range is expanding unceasingly, and the main performances are the compulsory insurance. However, in our country, the research on theory of environmental liability insurance is less and cities have carried on the attempt in the practice still have a large sum of problems. Therefore, it is valuable to explore in both practice and the theory.By utilizing the historical analysis, the valuable analysis, the comparative analysis and so on many kinds of research techniques, the article attempted to design a pattern which not only matches our country’s condition but also suits the correlative law system. Chapter1outlined the concept and functions, especially stressed the insurability, compared with the traditional theory of Insurance Law. Chapter2introduced the research of the development and practice of the typical foreign countries, study the legislation and special fulfillment of other countries. By comparing these systems, we get some enlightenment to improve our system. Chapter3focuses on the pilot of environmental liability insurance status, problems and causes. Based on these research related to the environmental liability insurance pilot survey units was summarized various factors that the environmental liability insurance is not successive. By using empirical methods, from the level of the legal system and taking a legal perspective, we proposed the proposals of the Environmental Liability Insurance Law Construction suited to China conditions. Chapter4proposed the ideas to construct the environmental liability insurance legal system in the preceding theoretical analysis and practical demonstration.
