Research On Responsibility Of Government In Rural Land Transfer Of China

Nowadays the most important problem of our rural land is the contradiction between fragmentation of land and scale production, the consequences of this contradiction is that agricultural science and technology and large-scale modern agricultural equipment can not effectively put into use, resulting in manpower and material wasted,the output of land and income of peasants are both influenced badly. We can resolve this conflict only by land transfer reasonably and effectively. But the local government, as the land managers, its special status and power make its responsibility greatly.In the process of land transfer, the Government should do everything from the perspective of responsibility to fully improve the land property rights system, and improve the land transfer management system, strengthen the government's social service system ability, and foster the land transfer market actively, it should establish a rural land transfer manage system and a public service system which matched with the level of productivity, requirement of rural development and the affordability of peasants Only in this way, land transfer market will be a sound and orderly one, then to promote the economy scale increasingly. The article is divided into three parts:The first part is an introduction, it defines the purpose and meaning of the thesis, makes a brief explanation to the background and the research status at home and abroad. The second part is the main part. It defines the responsibility of the government in the land transfer activities, elaborates the meaning of the land transfer and defines responsibility of our government in the land transfer process. Namely, administrative responsibility, legal responsibility and moral responsibility. But government responsibility would can be implemented only that it have a certain theoretical basis and the effective means. Then it analysis the government responsibility in the land transfer currently, firstly, it confirmed the government's achievements during the transfer process, and then pointed out the problems of government activities in the land transfer. Analyzed the results of wrong position of administrative responsibility, inrigidness of liability and the increasing risk of moral responsibility are imperfect legal system,non-standard transfer mechanism and unsound related policies etc. The last of this part is about how to strengthen the government responsibility. we must first improve the safeguard measures of government administrative responsibility; Secondly, perfect the government legal liability system. Finally, enrich the connotation of government moral responsibility. We can ensure that land transfers reasonably orderly and efficiently, the interests can be protected and the income of peasants increasing only by strengthen and implement the government responsibility. The third is the conclusion. I hope it can provide the theoretical basis of rural land transfer in China and points out the drawback, I will make it better in future.
