The UN General Assembly adopted the <Universal Declaration of the Rights of Man> in 1948. The concept of human rights has been ever-since shared objective of the world. People throughout the world regard the human rights concept as a way for protecting their dignity and benefits. And the ideology of human right is enhancing in the world s cooperation and communion. The world based on the national situation is changing and China is changing too. China's human rights theory as well as combining with the international trend steadily progressing. After the founding of PRC, particularly after the reform and opening policies were introduced in 1978, while the human rights development had experienced a rough period. It s value was reconsidered by the government and the intellectual circle. China's human rights development has attracted worldwide attention by obtaining theoretical output which provides important theoretical references for the world human rights undertaking. The protection of human rights was adopted into the Constitution of the People's Republic of China by 2004 and the guarantee of human rights was raised from the level of the Party and the Government to People and the Country. The Constitution has further confirmed the important status of human rights in China's law system and national development. China's human rights development will be a casting one. Finding the problem, considering the problem, solving the problem and seeking the meaning of human rights will always be the main part of development.This paper consists of 5 chapters.The Chapter 1 enunciates historical development of the human rights and the Marxist human rights. It has two parts: the first part includes the germ of concept of human rights, the evolution of human rights in history and globalization development of human rights. The second part expounds the Marxist human rights. It analyses the different and contact between Marxist human rights and capitalism human rights and the history of the Marxist human rights in China .The chapter 2 enunciates the thought expression and practice of human rights in Chinese history and the fighting progress for human rights in modern times. It has three parts: Part 1 expounds the thought expression of human rights in Chinese history and analyses the understanding for human rights idea in ancient society. The part 2 expounds the statesman and thinker who had taken the human rights idea into the practice. The part 3 expounds a rough and rugged fighting progress for human rights in modern times.The chapter 3 is the most important part of this paper. It mainly expounds rapid development of the national economy and human rights since China adopted the reform and opening-up policy after 1978. It has 3 parts. Part 1 mainly analyses the booming economy since China adopted the reform and opening-up policy in 1978. Part 2 enunciates the revaluation of the human rights by the Chinese government and the human rights adoption into the Constitution. Part 3 enunciates that Chinese human rights have changed a lot since China adopted the reform and opening-up policy, especially rights for living, rights for development, rights for economy and social culture.The chapter 4 enunciates the human rights theory with Chinese characteristics in the new era. It includes the unique development of Chinese human rights and the human rights theory with Chinese characteristics.The chapter 5 is the end chapter of the paper and it enunciates the challenge and bright future of Chinese human rights development.
