On The Land Right Of The Rural Females

The study is taking the land right of Hangzhou rural females for example, the paper studies the origin of the infringement by the view of gender and social justice, and presents the countermeasures. It is found that the infringements mainly exist on land contract, homestead servitude, land requisition compensation, land shares, and collective welfare. The main reasons are the lack of gender equality in law and the restriction by the folk laws, especially by the village rules. Meanwhile, the lack of administrative and judicial remedy aggravates the problem. It is suggested that, a perfect law system with gender difference, the proper guide on villager autonomy and the regulation on village rules are essential to guarantee the land right of rural females.
