In1970s, with the development and application of digital informationtechnology,electronic commerce which begin with the emergence of e-mail,appearedand developed firstly in the Western and was used extensively.After1990s,electronic commerce started in China and developing rapidly.As an important formof the electronic commerce,online shopping had won great favor of the consumerswith its efficient,fast and convenient features.However,online shopping is differentfrom the traditional manner of transactions.Because of its characteristics,such asvirtual,open and digital,standard clauses become the inevitable choice to reachonline trading agreements between operators and consumers.The appearing of eachtype of new things,new mode will impel new changes and innovation in the legalfield. The standard clauses in the online shopping contract will expose itsadvantages and disadvantages under the network environment which be opened upnewly,too.Therefore,around the questions of the standard clauses in the onlineshopping contract and how to control these effectively,this thesis mainly introducethe following sections.Firstly,the thesis mainly introduces the general theory ofstandard clauses,and further,introduces the concept of the standard clauses in theonline shopping contract and the problems during its practical applications.On thisbasis,we research the conditions that standard clauses subscribe into the standardcontract,the effect of the standard clauses,and the principles to explain the standardclauses in the online shopping contract.Finally we should expound how to control the online-shopping standard clauses,combine with the legislations of the foreign andthe market development status in our country.In this way,we can regulate the orderof the domestic,safeguard the interests of the market players,and create a goodtrading environment.... |
