The Research On Legal Ensuring For Newly-generated Peasant-workers

As the renewal of age structure for peasant-workers, there appear new generations of peasant-workersas the main body, which are called "newly-generated peasant-workers". Compared with previouspeasant-workers living conditions in urban areas, theirs are lack of realization or hardly ensured. However,they are a little bit different from previous generation in survival ideas. They look on the city as theirpermanent living place, and eagerly want to settle down in city whose development is needed to expand bythem. The title of newly-generated peasant-worker is determined by No.1documents of CentralGovernment of CCP, which means that to solve their survival problems are obviously significant. As soonas the peasant-workers are mentioned, we will associate with ideas in sociology, economics, politic science,etc. As the development of society and economy, more and more peasant-workers seek jobs by flowingfrom rural areas to cities, which influences profoundly and lastingly social life in practice. The problemsconcerning with peasant-workers are presented more and more at level of legislation and managements.Peasant-workers are the results of the development of time, and the problems concerning with them willcertainly occur, which is inevitable during urbanization and industrialization of a country. So, the calling ofpeasant-workers is featured with being transitional, and will disappear along with the high development ofurbanization and industrialization certainly. Three-rural issue is the fundamental problem in China, andproblem of peasant-workers lies in the core. The newly-generated peasant-workers who were born in1980's or1990's are the main forces among peasant-workers. At present, it is the important time with urbantransition and development, and how to solve problems of newly-generated peasant-workers is necessarilyimportant. The highlighted contradiction of it is that their aging structure has changed greatly, which is alsoexpressed as intergenerational replacement by many scholars. Newly generated peasant-workers have moredesire to integrate themselves in urban life with new characters and new requirements, compared withprevious peasant-workers. Although they are replaced internally, the problems of them still remainunsolved properly. New problems have emerged along with the intergenerational replacement because theylive in urban area with lack of deficient rights, compared with the urban residents'. The new generation ofpeasant-workers is called newly-generated peasant-workers, which is determined by No.1documents of Central Government of CCP, meaning CCP and Chinese government care about peasant-workers,especially the newly-generated workers as well as expressing the highlighted attention to newly-generatedpeasant-workers problems. To solve problems of newly-generated peasant-workers in a nationwide levelshows the significance to promote national economy and social development of China. The main barrierexisting between urbanization and industrialization of China is transforming into urban residents ofnewly-generated peasant-workers and their legal rights. Therefore, it's imperative to clear out barriers forthe development of the society. As a social problem, newly-generated peasant-worker problem has beenstudied in aspects of administration management, social security, etc by many scholars. However, theresearch on legally ensuring their rights, solving problems concerning with them is still needed. So, thisessay analyzes the importance of how to legally ensure the rights of newly-generated peasant-workers.
