| Exacting a confession by torture is a vile practice which is still present in modern criminal action despite repeated prohibitions, and it is also a critical problem in theoretical researching on legal action. To begin with the concepts of torture, the essay explores its institution source and existence condition. Based on these, this article analyzes the causes and harmfulness that torture is still present even though lacking of its institution condition, and puts forwards some related legal countermeasures for eradicating exacting a confession by torture. |
