On The Electronic Evidence Of The Role And Use Of Confidential Administrative Law Enforcement

With the rapid development of the science and technology, especially information technology, more and more people are using computer to work, to study and to do other things. The process of dealing with the State secrets is involved with this trend. The producing, storing, managing and destroying of State secrets are depended on computer and other electronic equipments. The new way of managing State secrets result in many electronic evidences that will be deal with by the National Administration in the process of administrative enforcement of law of protection of State secrets. This paper explored why the electronic evidence are important in administrative enforcement of law of protection of State secrets, and give some reference tips concerning how to use electronic evidence in administrative enforcement of law of protection of State secrets.The whole article covers two chapters. Chapter I firstly start with an introduction about the definition of electronic evidence, including the types of the definition of electronic evidence in some foreign countries with two representative legal systems, and the main theory in this field in our country. Then discuss what kind of evidence the electronic evidence should be by focus on the different between video an audio materials and electronic evidence. This chapter is also introducing the characteristics of the administrative enforcement of law of protection of State secrets and the specific problems of the administrative enforcement of law of protection of State secrets caused by information technology.Chapter II proposed some principles of applying electronic evidence in the administrative enforcement of law of protection of State secrets. Then the paper listed three questions of the process of applying electronic evidence. At the final stage of this paper, the writer draws the conclusion that electronic evidence plays an important role in administrative enforcement of law of protection of State secrets in the information era.
