The Improving Of The Trade Remedy Legal System Of China

Trade remedy is a kind of protection measure which is allowed by the WTO rules. Since China's accession to the WTO, the study and practise of China's trade remedy legal system are becoming richer and more mature.But most of the studies on trade remedy are limited on the introduction of the WTO rules and the practises of some WTO members.Those studies mainly interpret trade remedy from the view of International economic law, and emphasis the consistence between the domestic legal system and the WTO rules.Thers are few studies on the comprehensive analysis of the development of the multilateral rules on trade remedy and China's trade remedy legal system.By comprehensively analysing the development of the multilateral rules on trade remedy and comparing the legal systems of the main WTO members, this article tries to demonstrate the development and deficiency of China's trade remedy legal system, and provide some constructive advises on the improving of China's trade remedy legal system.The article consists of three parts. The first part introduces the concept, history and legal framework of trade remedy,and then concludes the legal features of trade remedy. The second part compares and analyses the legal systems of the main WTO members on trade remedy.The third part demonstrates the development and deficiency of China's trade remedy legal system, and provides some constructive advises on the improving of China's trade remedy legal system.
