Research On The System Of "Administrative Criterion Documents' Filing And Reviewing＂

Administrative criterion documents are important administrative measure and method for the government and its departments to execute laws, regulations and rules. Meanwhile, it is the important content of legal administration as well. Administrative criterion documents'filing and reviewing is a vital item for government to implement layer supervision, which is also an effective measure to regulate the government's nonobjective administration.There are many problems both in theory and in practice for the system of administrative criterion document's filing and reviewing. Therefore, it is necessary to study the system from the theory of administrative law.This paper consists of three parts. Part one defines the concept and characteristics of administrative criterion documents, the further defines and expatiates one the concept, history, characteristics and contents of the system of filing and reviewing, and discusses the necessity of the system. Part two analyses our country's present situation of " administrative criterion document's filing and reviewing " system both in legislation and in execution, pointing out the existing problems of the system. One problem is that at present different governments and different departments of governments do not have enough knowledge and regards on this job of " administrative criterion document's filing and reviewing", which resulted in no same doings, experiences and regards over this work between different governments and governmental departments. Problem two is that related governmental departments are not solely established, hence no adequate professional especially law professional to be involved into this work, which resulted in the quality of reviewing is not high. Problem three is the scope of reviewing is not clear. Problem four is the standards of reviewing are not in unification. Problem five is results of reviewing are not certain. Problem five is no responsibility system, etc. Part three advances some suggestions and measures to solve these problems, such as improving our country's legislation, strengthening the "administrative criterion document's filing and reviewing" of province government level, specifying the object and scope of administrative normative documents'filing and reviewing, enhancing the efficiency of the organization and the government employees, to uniform the standards, to set up responsibility system, and to improve other relative systems, etc.
