Validity Of The Contract Theory. Insurable Interest In The Life Insurance

The object of study, involving the core principles of insurance research, principle of insurable interest. As a personal insurance, insurance benefits is the basic principle of the insurance contract effectiveness, insurance contract relationship and to establish the system of the insurance contract. However, the principle of insurable interest is very complex, its application in dispute is also big, especially in the cases involving personal insurance, continental law system and common law practice is quite different. This paper, particularly in countries of Anglo-American law system about insurance benefits and theory, combined with our new insurance of insurance, the insurance benefits influence on insurance contract effectiveness analysis and discussion on the new "insurance law" (2009) of article 12 "insurance interest" terms for the old "insurance law" (1995) of the theoretical basis and practical basis, and interpreted in the future in China are discussed, for insurance and insurance contract theory research and system consummation.
