Research On Issues Of Patent Right Investment Laws

Patent right investment is one important mode of the capitalization of intellectual property rights, With intellectual capital plays an increasingly important role in the operation and competition of companies. In many innovative high-tech enterprise's capital composition, with the patent rights for the form of capital contribution is increasingly becoming a common phenomenon. Aims of the patent right investment from a legal point of view on issues related to research.Through comparing America, Europe, Japan and other developed countries where the theory and legislation of Patent investment are relatively complete, combined with China's current theories and practices, mainly by analysis and induction method, some basic and targeted research and discussion about a series of problems such as eligibility for patent right investment, the proportion of patent right investment, the risk of patent right investment, valuation of patent right investment, legal procedures of patent right investment, the law liability of promoters or shareholders and so on have been carried out by the author. Finally, on the basis of such research and discussion, the author makes some legislative suggestions on the perfection of China's patent right investment system with the expectation that the patent right investment system in China can be more scientific, more reasonable and more standardized through these suggestions, and ultimately to maximize the effectiveness of the patent right investment system.
