Our Network Virtual Physical Protection Related Legal Issues Research

With the development of network game industry,there are urgent promble,especially in the areas of protection for network virtual property,need to be solved and regulated.But,in china,there are controversies in the legal nature of network virtual property.And also there are no clear on network virtual property in current law,judicial interpretations and regulations,it is hard to protect network virtual property in practical operations.This paper will begin logical start regarding with network virtual property——legal nature of network virtual property ,comprehensively use the following research methods:structural analysis,empirical analysis and so on,to do the legal analysis and argumenations on network virtual property,.And at the same time,the comparative method will also be used, by comparing and analysizing legislative systems of network virtual property in foreign countries, as well as in Taiwan,HongKong in china, considering practical operations,I will put forward some of own proposales.And according to the logic order,this paper will be disscussed in five chapters, into which is divided in a progressive structure.The first chapter will mainly explore the reason and method of researching network virtual property,which is significant now. It also need proper method to researching network virtual property.The second chapter is key part of this paper.Through comparing and analysizing with all kind of theory of the legal nature of network virtual property,we can make claritfy logical start regarding with network virtual property——legal nature of network virtual property. Also I will pur forward some own proposales combining with practical operations in China.The third chapter r is also key part of this paper. It will focus on comparative method. Through comparing and analysizing legislative systems of network virtual property in foreign countries, as well as in Taiwan,HongKong in china,we can make make up a model about network virtual property of protection from macro and micro.The fouth chapter will explore status quo which has been network virtual property of protection throgh: legislation judicial and enforcement under the framework of a model about network virtual property of protection.The fifth chapter will focus on the viable tentative idea about network virtual property of protection from substantive and procedural law under the framework of a model about network virtual property of protection.
