Study On The Legel System Of Ship Oil Pollution Compensation

As China's rapid economic development, the demand for oil resources will be increased, increasing the amount of oil in the sea transport. According to authorities estimated that in 2010 China's national economy on oil demand for 3 to 350,000,000 tons, the required volume of about 170 million tons of oil imports.China's future demand for oil will continue to increase. Frequent maritime oil transport increases the risk of oil pollution accidents in our country.In case of oil spill on the marine environment and our people's lives and property will result in incalculable damage.Under the great threat of the ship oil pollution damage, accelerateing our oil pollution compensation system's research is urgent.In the international legislation,oil pollution damage caused by the issue of compensation has many international Convention, developed countries such as the United States and Canada also have their own legal system, the international legislation has formed a set of the Liability Convention and Fund Convention protection for the dual legal system.The legal system of oil pollution damage compensation in China inadequate, which is not conform with the rapid development in the maritime transport industry and is not conductive to our protected coastal environment and the victims.Therefore,building a complete system for oil pollution damages is really indeed.This article, the authors first discriminates the oil pollution compensation concepts, then analyzes the international convention on oil pollution damage, as well as developed countries, in the fourth chapter explained the core issues on the legal system of compensation for oil pollution damage, such as the scope of compensation, the compensation of the main controversial issues, and put forward own proposals in this regard, combined with my last article, the status of oil pollution damage and the existing ship the legal system of compensation for oil pollution damage provisions, compensation for oil pollution damage on China's shipbuilding establishment and improvement of the legal system put forward their own a modest proposal, in order to probe into our own ships of the legal system of compensation for oil pollution damage.
