Emotional Distress, which is known as "Emotional distress" in American Law, and called as "nervous shock" in English Law, has been gradually developed as a legal terminology for the latest century in mental harm compensation field of tort law. Emotional Distress is referred to the victim inflicted emotional harm directly from the infringer, instead of suffering the scare or panic owning to the damage of physicality personal right. The consequent compensation system aims to resolve the problem of how to obtain the compensatory payment when the victim suffers severe mental harm.In Anglo-American law, the emotional distress can be divided into two categories based on the infringer's different subjective states:the intentional torts or the negligence. No matter intentional or negligence, with development of the compensation system of emotional distress the range of victim protection have been gradually expanded from direct victim to the third party, which include the one having family relation with direct victim or not. Severe requirements are established in juridical practice when identifying the emotional distress no matter which type concerned.With the far-rapidly development of economic and society, spiritual interests have been paid more attention and the institution of damages for mental injury plays an important role in this process. The tort liability act of PRC has only one provision to formulate the compensation system of mental harm, which leaves space for improving and perfecting the system of emotional distress. Through analyzing laws and acts that PRC have been applied in the related range, as well as the draft of judicial interpretation of tort liability act, design the legal provisions of compensation system of emotional distress in this thesis.
