The Study On Legal Status Of The Rural Civil Economic Organizations

Making a general survey of the agricultural experience of those developed countries and regions, the increase of economic interest in agriculture and the agricultural modernization process depend on an important factor---the rural civil economic organizations. At the same time, their development and maturity degree has become one of the important indicators of agricultural modernization in all countries and regions. At present, the research on legal issues of the rural civil economic organizations is very deficient, especially the specific problems. The rural civil economic organizations have neither a definite legal status nor a specific system yet, and there are not sufficient relevant measures, which hinder the development of rural civil economic organizations greatly. Therefore, at the time of "three rural" issues that must be resolved in China, according to China's actual situation, there are very important theoretical and practical significance to use the advanced experience inland and outland for reference, to give the rural civil economic organizations a definite legal status, to solve the civil legal issues which hinder the development of rural civil economic organizations.The full paper has three parts concretely, that is introduction, body and conclusion.The introduction part describes the research significance of the rural economic organizations, which leads to the issue of their legal status.The body part describes three issues:The first one is the relevant theories about the rural civil economic organizations. To study an organization, we must firstly clarify and define the basic theoretical issues such as concepts and classification. It is the basic step to proceed. Scholars have different views on the concepts and classification of the rural civil economic organizations. This part is to solve these two questions"What is the rural civil economic organizations?"and"What are the specific types?"in order to make further study proceed smoothly.The second one is the current legislation and its assessment of the rural civil economic organizations. Through the analysis and evaluation, we can find the consequence of the lack of definite legal status, and analyze how to definite it. Besides that, the modern rural civil economic organizations came into being in the 30s of last century. The history is short and the development and the theoretical research are not mature. Through analysis and study, we can learn from the legislation of the legal status of rural civil economic organizations in some developed countries.The third one is to research on the exist problems about establishing the legal status of rural civil economic organizations in our country and then to put forward some methods to solve them. The establishment of Chinese rural civil economic organizations has some problems such as vague legal nature definition, informal organizations, incomplete management system and delayed legislation. The resolutions of these major problems are the linchpin to definite the legal status of our rural civil economic organizations.The conclusion part points out that this study is to establish a new legal entity status of rural civil economic organizations.
