| In recent years, the bribery crimes are gradually showing the complex characteristics as the crack down on the combat corruption in our country. Especially, the"people"around the state functionaries seek illegitimate interests, ask for or accept trustees of property by using the influence of the state staff members and this phenomenon has become a danger to our socialist constructions. With the approval of the Criminal Law Amendment Seven, such acts are effectively curbed. This article describes the concept, characteristics, significance, legal interest, components of the trading in influence, and then summarizes and analyzes the differences with other kinds of briberies and the difficulties in judicial practice by using the principle of a legally prescribed punishment for a specified crime, and submit the effective amendment for the missing of the criminal legislation and the judicial aspects of this crime based on the previous issues. Finally, the legislative purpose is to protect the human rights and fight against the crime from reducing the possible deviations of the judicial application in the source. |
