Criminal Reconciliation

Victim Offender Reconciliation has become the hot topic in Chinese law schools as well as the reforming field in legal affairs. This concept has been promoted and applied gradually in the criminal justice since it meets the needs of harmonious society construction, conforms to the requirements of policy of combining publishing with leniency legally, corresponds to the ideas of restorative justice and victim protection theoritically and adjusts to the international criminal justice reform and experience. From the angel of justice and effectiveness, the author focus on the effectiveness of reconciliation. It not only can protect the benefits of the victim, but also keep the rights of the offender; not only uphold the social public interests, but also better the judical resource and the effiency. All these lead to the realization of winning in many fields and the final goal of society harmony.Based on the historic development of reconciliation, the author elaborates the theoritical and practical condition of reconciliation in China and analyse the problems in the judical pracitces. A basic scheme has been proposed in terms of the cases, conditions, models, application, duty, procedure and facility. And the suggestions have been forwarded to build the rule of law.
