The Legal System Of The Space Right To Explore

In modern society, the acceleration of urbanization development causing the urban population with the rapid expansion and the urban land increasingly scarce contradiction. Aiming at this contradiction, using technology means for human development and utilization of land by planar region turned to stereo space. Space right system in some countries and regions has established , but there was no establishment conforming to our country actual space right system. Basing on China's national conditions, this paper finds out the building space right system basis of reality, and drawing lessons from various countries and regions in the world of space rights legislation, combining the theory and practice of our country, space right system establishment opened legislation.This paper except the introduction and the conclusion, main part is divided into three parts. The first chapter mainly introduces basic problem of the space right, and then the author space ownership exist independently is not against the principle of "one thing, one right". The second chapter analyzes the current social form, and expounding the space right to establish the reality of the situation, and the legislative cases for space right system of the countries and regions is introduced, laying the theoretical and practical basis for space right system establishment. The third chapter research the space right legislation in our country at present, and putting forward Jus In Rem should have acknowledged concept of space construction lands use right, establishing space rights system rules in our country.
