Electronic Notes Study

With the development of electronic science and technology, as well as with the popularity of electronic communication and internet, electronic negotiable instrument as a payment instrument has been used for long time and has influenced people's economic life. Electronic negotiable instrument has adapted to the trend of electronic business and has been considered as the best paying means in finance. The advantages of electronic negotiable instrument compared to the traditional bill are in its quickness, efficiency and security, which has adapted to the development of electronic business and network. The paper is based on the theory of electronic negotiable instrument, and discussed the right and obligation relationship of various law parts. The paper then analyzes a lot of risks in the circulation and the cause of electronic negotiable instrument's risks. The paper also probes into avoiding risks by using legal norm and replying to the traditional criminal problems in the new law situation. At last, it puts forward some opinions of building perfect electronic negotiable instrument system in China.
