Countries to the existence of state-owned assets, operation of the material basis, and in the social transition has always been a serious problem plaguing us is the loss of state assets. At present, China's state-owned total assets of about 10 trillion, but according to statistics, every year for various reasons the loss of billions of dollars of state assets, had an increasing trend, in which most of the assets of state-owned enterprises, this is a serious constraint the healthy development of China's economy a major issue, the theoretical circles of this issue in-depth research.This article is drawing on the existing basis of theoretical research on how to prevent loss of state assets in China were discussed. This paper introduces the concept of state-owned assets and the state-owned assets, the formation and development; and then, on how to define the loss of state assets and the status of state-owned assets have been described. Secondly, the way the loss of state assets and the main reasons for analysis. Once again, foreign owned assets management system introduced by analyzing the advanced foreign management practices of state-owned assets, made on state-owned asset management of inspiration and reference, and finally, to prevent the loss of state assets on legal strategy and thinking.In this paper, the loss of state assets to prevent the legal response, the main contents are: First, the state-owned assets management system is envisaged, including the establishment of state assets in place mechanisms to authorize state-owned assets management system reform, improve the state-owned assets supervision and restraint systems, etc.; the second is state-owned assets legislation and the idea of law enforcement, including the establishment of state-owned assets law public interest litigation, improve the disposal of bad assets of financial laws to strengthen law enforcement and so on.
