The Constitutional Protection Of The Right To Health

Health is crucial to the person's subsistence and development. The right to health is one of basic human rights announced by the international human rights convention and the region human rights document, which has been stipulated in most national constitutions as citizen's basic right. Observing the status of the right to health protection throughout the world, we can see its constitutional protection has become a common practice. However, at present the China's constitutional status of the right to health is missing, protection of the right to health by general law is imperfect and feeble, then there are some prominent problems such as ineffective government regulation ,inadequate information publication and lack of an effective Constitutional Review. So to solve these problems fundamentally, the first step of constitutional protection of the right to health is we should write the right to health into the constitution text, then consummate the relevant legislation and resolve the poor government regulation issue .Finally we must perfect Constitutional Review.
