On Analyzing A Case Of The Offence Of Concealing Proceeds Of Crime

On one hand, defining the offence of concealing proceeds of crime makes up some defects of stolen property crime. On the other hand, because of there are no judicial interpretions, some new matters occur when dealing with this offence. This thesis analyzes some problems in this offence by a case in our daily work. This thesis is devided into three parts:foreword, main body and conclusion and the main body includes three chapters.Chapter 1 introduces the details and focuses of the listed case.Chapter 2 analyzes the theoretical issues of the offence and the details of the case. First, analyzes the substantive issues of this offence from the following aspects:the change of names of this offence, comparison of the legislation, the conception and elements of this offence as well as the problems in the administration of justice. Second, analyzes the procedure of the case of this offence from the following aspects:the form and trait of the criminal evidences, the features of evidences of such cases and how to investigate the evidences of the cases. Last, gets the conclusion that the boss of the scrap yards is not guilty by analyzing the crime constitution and evidences of the case.Chapter 3 is a reflection to this case, which focuses on the specificity of this offence and propose some notes when identifying such cases.
