Research On Privacy Policy And Management Of The Technology Contract

As technology advances and progress, the signing of the contract of technology more and more, according to statistics of 2009, a total of 213752 technology contracts were traded, turnover exceeded 300 billion RMB, up 303.9 billion RMB. However, there are still problems in technology development, transfer, licensing and etc. especially in the contract of technology, which also have many privacy problem at the process of signing, performance and management in the technology contract, for example, lack the privacy policy in a technology contract, that influence the normal performance of the technology contract, in the performance of the contract process does not comply with the privacy policy which result the disclosure of technical, at the management process failed to sign confidentiality agreements which related to the formation of security loopholes in the management. These problems given the economic loss of two parties to the contract and inserted the progress and development of technology.In this context, research the problems in the privacy policy of the technology contract at the process of signing, performance and management in the technology contract, have a strong theoretical and practical significances. The research object in this paper is privacy policy of technology contract, solve the privacy problem exist at the process of signing, performance and management in the technology contract. First this paper gives a simple comb of the concept about technology contracts, privacy and the definition of the scope in this paper. Second, find out the issue in the process of signing, performance and management of the technology contract and the root causes of these problems. The third analyses the necessity of sign the privacy policy in various technology contracts and give a theoretical basis of solve these problems. In the last of this paper give the suggestion about how to sign the privacy policy and how manage the privacy policy of technology, improve the laws and regulations. Study these questions can be further found the problems in the performance and management of the technology contract ,and make the experience from home and abroad to promoting China's technological progress.
