A Research On Service Inventions Remuneration System In China

With the global economic growth mode transform to knowledge economy mode, the quantity and quality of service inventions as the representative of technological innovation capability is becoming the key factor of national economic growth and competitiveness. The efficiency of service inventions remuneration system directly impact on the quantity and quality of service inventions. Chinese inventions remuneration system is the main object of study in this paper. This paper try to give some advises on improving the present system by the study of existing problems and learning from international experience.Chapter II summarize the overview of the present service inventions remuneration system in China through analysis of service inventions remuneration legal system and legislative history. Chapter III summarize the overall situation on the quantity and quality of service inventions in China by analyzing the patents granted data from 1985 to 2008. Case study is another efficient way to find the main problem of national service inventions remuneration system. Chapter III also summarize the main problems of the present service inventions remuneration system by analyzing two typical cases occurred in recent years. Chapter IV provide some international experience through analyzing service inventions remuneration legal system in Germany, Japan and the United States.Finally, basing on the research conclusion, Chapter V present some academic and legal suggestions on improving the present service inventions remuneration system in China, including defining the nature of remuneration, improving the rights of content and improving the calculation of remuneration.
