On The Improvement Of The System Environmental Liability Insurance

With the development of Chinese economic,enviromental problems is day by day prominent and becomes a social problem which influences the survival of morden people.Therefore, expounding how to make the compensation for victims much better becomes the main contents of the research on the modern environmental law.The rising of liability insurance provides a new vision for solving the compensation for environmental damages.This thesis discusses the estsablishment of environmental liability insurance and the theoretical basis through the analysis of the model and the concrete system of foreign environmental liability insurance in order to establish and improve the environmental liability insurance system which is suitable for national conditions.The first part introduces the establishment of the environmental liability insurance system and the theoretical basis,and gives the definition of the connotation of liability insurance.The second part focuses on expounding the current situation, the legislative state, the existing problems and the causings of our liability insurance. The third part uses the region as a clue, displays the history and the present of the environmental liability insurance system by introducing the international enviromental tresties and the practices around the world.It mainly discusses the international enviromental insurance system by the the implementation status of environmental liability insurance and summarizes the common characteristics of national systems and to extract the reference to China. The last part designs the environmental liability insurance system through discussing the insurance, insurance agencies, insurance settings and the premium rate.With the method of comparing the foreign models of the environmental liability legislation,analyzes the single legislation model and proposes the feasibility and the reality of it in our country.
