In recent years, drug tide of the world spreads without restriction, and drug-taking population in countries of the world is increasing day by day. Drug tide of the world also has some effect on our country. Now drug-taking behavior of our country can not be forbidden, and the problem of drug-taking is becoming more and more serious. Drug-taking has serious social harm. It not only does harm to people's health even the life, but also can give rise to social problems such as the increase of crime rate. So many countries (or regions) regard drug-taking behavior as crime, and it has a good effect, making the population of drug-taking become less. However, law-making stipulation of our country regards drug-taking behavior only as administrative offense, and it has little effect, with the result that drug-taking population doesn't decrease. So it's necessary to use for reference of other countries'current stipulation about the criminalization of drug-taking behavior, and better our country's law-making stipulation. This will have theoretic and realistic significance in reducing the harm of drugs, strengthening the control on drug crime, and maintaining social stability.The thesis's title is "research on the criminalization of drug-taking behavior", and it mainly does research on several countries'law-making stipulation on the criminalization of drug-taking behavior, making the conclusion that our country should incriminate drug-taking behavior.The thesis includes five parts. The first chapter introduces briefly drug-taking behavior's characteristics and harm. The second chapter points out countries (or regions) of the world's law-making stipulation on incriminating drug-taking behavior, and it sums up the good points that our country can use. The third chapter points out the history from Qing Dynasty to today of our country's control on drug-taking behavior, illustrating our country has a long history of forbidding taking drugs. The forth chapter uses seven reasons to explain the feasibility of incriminating drug-taking behavior in our country. The last chapter proposes concrete measures, such as drug-taking crime's concept, design of constitutive elements of crime and legally-prescribed punishment and so on, mainly because our country doesn't incriminate drug-taking behavior.I hope my injudicious opinion will provide a new train of thought in bettering our country's interrelated institution of law on the control of drug-taking behavior.
