Legislative Research Of China's Economic Development Zone

Generally speaking, lawmaking refers to the establishment of laws. In a broad perspective, lawmaking means the law making,modifying and annulling activities carried out by the country's special organ following the will of state power's dominating social group, in accordance with statutory authority and procedures, based on certain guiding ideology and fundamental principles. The lawmaking issue of development zone this paper dedicated on is defined within this broad perspective, that is to say, it includes the formulation,modification and revocation of current laws,administrative regulations,stipulations and ordinances of the development zone related to adjusting certain legal relations. There are quite a few of theories backing up the construction and development of development zone, however, the mainly theories are as following: the regional imbalance development theory,the growth pole theory,the cluster theory,the industry division theory,the technical innovation theory. This paper will briefly introduce the aforesaid theories, so as to lay down the theory base for following discussion. There are a lot of various development zones in our country, yet they share some features, such as relying on urban development, coexistence with urban development, industry clustering as economic developing advantage, enjoying special preferential policies, with special management system. The construction and development of our country's development zones have been through stable start-up stage, fast-growing stage and developing adjustment stage. The establishment of development zone has driven the fast economy development of many regions and the country as a whole, it is the growth point of the urban economy development. However, our country's development zones generally have many problems, such as, the use of land is not rational, squandering activities are not without existence;the management committee has no clear legal status and the management system is not explicit;the preferential policies are weak;there are problems with industry development, etc., while there are different specific reasons for the rising of each problem, the writer is to analyze them one by one.Dalong Circular Economy Development Zone in Yupin Dong Autonomous County of Tongren City of Guizhou Province is a provincial economic development zone set up in 1999 and certified by people's government of Guizhou Province. In 2005, Guizhou Development and Reform Commission listed Dalong development zone as a provincial circular economy testing zone. In 2006, this zone was verified by the National Development and Reform Commission and became the only provincial economic development zone of the fourth round certified zones in Tongren region. Dalong economic development zone is listed in the intersection of radiation zone of The Pan-Pearl River Delta Economic Circle, Chongqing Economic Zone, China - ASEAN Free Trade Area. It radiates qiandongnan and is an important connecting point northeastern guizhou province.In " Yu Tong Song circulation industrial belts ", the Dalong economic development zone is in the key position established now.At present, the Dalong economic development zone has developed into a new industrial base , export base and thermal power energy center in Tongren.But the development of Dalong economic development zone faces with many problems now, such as: Expand construction of the zone, Management committee Lost Legal subject qualification,policy preferential weakening, circular economy development mode encounter difficulty etc. Above problems because both the development zone itself, and the trouble of Dalong economic development zone own.Finally, combined with the case study of Dalong economic development zone,and set up support theory, the author puts the present legislation suggestions forward the development zone .
