Antitrust Regulation Of Power Market

Power industry,as a traditional natural monopoly industries,is excluded from the scope of application of Anti-trust Law.However, with the development of economy and technology, the power industry reform, people have new understanding about power industry and gradually regulate it with Anti-trust Law. Many countries around the world have adjusted their Anti-trust Law,made power industry into the application of Anti-trust Law. In order to comply with the world trend and serve the economy better, China also enacted Anti-trust Law. Antimonopoly law of the People's Republic of China improved our lagal system,but there are many shortcomings in it yet, and it also can't meet people's eager expectation. The promulgation of the Anti-trust Law do not eliminate people's worries about monopolies in power industry. Antit-rust Law does not take its stand clearly and design concrete system about the monopolies, so it couldn't obviously improve the situation that administrative monopoly and economy monopoly intertwined in the power industry.In my opinion, Antit-rust Law should apply to the power industry as well, and it should regulate administrative monopoly in power industry in a strong way. This article is divided into four parts. The first part expounds the necessity and feasibility about power industry excluded from the scope of application of Anti-trust Law. The second part introduces and analyzes foreign electricity market antitrust regulation system to assess and accumulate experience. The third part introduces and analyzes the legal status of antitrust regulation in power industry. In this part, we can understand the deficiencies of current law about the antitrust regulation in power industry.Then, we can seek ways for solving these problems. The last part puts forward a lot of improvement suggestions about antitrust regulation in power industry. This is the key part of this paper. It discusses that the power industry should be regulated by Antit-rust Law and other relevant laws.
