Initial Research On Administrative Demonstration Action In China

The administrating concept of modern government contains democracy, rule of law and service. Nowadays, the government put emphasis on how to accelerate the transformation of government functions from power control to service. As a result, the administrative action is much preferred by the government due to its weak enforceability. Administrative demonstration action is a new-born way, coming with the development of the society. It is an administrative action, which is not characterized by compulsory administrative and needs the administrative body and private party to finish together. Because the administrative demonstration action is in an initial research stage, lots of immaturities exist although it has many unique advantages. Accordingly, this paper explores the administrative demonstration action from the aspect of administrative law, analyzes its characteristics and compares it with the modern existing behavior. Through summarizing the development of the administrative demonstration action, we analyze its inadequate and make some related suggestions. The paper can be divided into the following four parts.Part one argues the necessary of researching the administrative demonstrate behavior. In this part, we point out its difference comparing to the modern existing behavior. The research not only enlarges the theoretical system, but also sheds light on the ways of transformation of government functions. Moreover, the administrative demonstrate behavior quite diffuses in practice. Therefore, we need to set up a unified specification in the administrative demonstrate behavior.Part two analyses the typical actuality in the example of administrative fields which suit the administrative demonstrate behavior. Because the research on it is the first time so far, it is quite necessary to analyze the existing behavior. In practice, the administrative demonstrate behavior has a large number of existing and in lots of fields, it is not the same. This paper put emphasis on analyzing the education field, culture field, economic field and society management field. From these, we can summarize nearly the whole actuality in China. Part three conducts the theories of the administrative demonstrate behavior and defines its concepts as follows:to realize the purpose of administrative management, according to the application of private party, making it as the model of others based on the law and policy. After defining the concept, we compare it with the similar four administrative behaviors and conclude it cannot be contained by others.Part four make the further thinking to confine the administrative behavior in China. From all the aspect of administrative behavior, we should set up whole system, including improving the law, confining the enforcement and providing the relief mechanism.
